2. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to misuse the Site, interfere with its operation, or attempt unauthorized access.

• Do not violate any applicable law or regulation.
• Do not transmit unsolicited advertising or spam.
• Do not introduce malware or attempt to disrupt the Site.

We may update, suspend, or withdraw the Site (in whole or part) without notice and are not liable for any resulting unavailability.

3. Services & Engagement

Any engagement for Services will be governed by a separate written agreement (Proposal, Statement of Work, or Master Services Agreement) detailing scope, deliverables, fees, payment terms, and other specifics. These Terms apply in addition to such agreement; where they conflict, the signed service agreement prevails.

4. Fees, Payments & Refunds

Fees are as specified in the applicable service agreement or proposal. Unless otherwise agreed, invoices are due upon receipt and are non-refundable except where required by law or expressly stated in these Terms.

Late payments may accrue interest at the rate defined in the service agreement (or, if not specified, at the maximum permitted by law). We may suspend Services or withhold deliverables for overdue accounts.

5. Intellectual Property

BST retains ownership of all Background IP, including underlying technology, frameworks, methodologies, tools, and know-how used or developed in providing the Services.

Client ownership or licence rights to deliverables will be specified in the applicable service agreement. Unless otherwise agreed, ownership of custom deliverables may transfer to the Client upon full payment; BST may retain a non-exclusive, perpetual, royalty-free licence to use deliverables for internal purposes, demos, portfolio, and further development.

The Client grants BST permission to use the Client’s name and logo in our portfolio and marketing unless prohibited in writing.

6. Confidentiality

Each party will protect the other party’s Confidential Information and not disclose it to third parties except as required by law. Confidentiality obligations do not apply to information that is public, independently developed, or lawfully obtained from a third party.

7. Warranties & Disclaimers

BST will perform Services with reasonable skill and care in accordance with professional standards. Except as expressly set out herein or in a service agreement, BST disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

The Site and Content are provided “as is”. We do not warrant that the Site will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by law, BST’s total aggregate liability for claims arising out of or related to the Site or Services shall not exceed the total amounts paid by the Client to BST under the specific service agreement giving rise to the claim.

BST shall not be liable for indirect, incidental, special, punitive, or consequential damages, including loss of profits, data, business, or goodwill.

9. Termination

Either party may terminate a service agreement per its terms. BST may suspend or terminate access to the Site or Services if you breach these Terms, fail to pay fees when due, or become insolvent. Upon termination, you shall pay for Services performed up to the effective date and any non-cancelable commitments incurred by BST.

10. Privacy

Your use of the Site is also governed by our Privacy Policy. Unless otherwise defined therein, terms used in the Privacy Policy have the same meaning as in these Terms.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of India. The courts located in Hyderabad, Telangana shall have exclusive jurisdiction for disputes arising out of or relating to these Terms, the Site, or the Services.

12. Refund & Cancellation Policy

12.1 Software Development & IT Services

• Cancellation requests must be made in writing within 7 days of payment or as per the signed agreement.
• Work already completed and third-party costs (e.g., domain, hosting, licences, cloud, manpower) are non-refundable.

12.2 Platform-Based Products (e.g., eTravelSmart)

• Bus-ticket cancellations and refunds are governed by the policies listed at eTravelSmart Terms.
• Where a refund is approved, it will be processed to the original payment method within 5–7 business days.

12.3 No-Show / Operator-Side Issues

For travel-service disruptions (delays, cancellations, service changes) caused by bus operators, refunds (if applicable) follow operator rules as displayed on the booking platform.

12.4 How to Request a Refund

Email your request to customersupport@etravelsmart.com with:

• Subject: Refund / Cancellation Request
• Transaction ID / Order ID & payment date
• Product or Service name (e.g., eTravelSmart ticket, development milestone)
• Reason for cancellation

13. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Your continued use of the Site after the effective date constitutes acceptance.
